Acceptable Use Policy

1. Overview

This Acceptable Use Policy (AUP) explains what you may not do with Brainpercent, operated by Brainpercent, LLC (Delaware, USA). It supplements Section 9 (Acceptable Use) of our Terms of Service. You use Brainpercent to generate AI content (text, images, video, music) and to publish it, at your direction, to social accounts you connect (Instagram, Facebook, TikTok, LinkedIn, X, YouTube, Pinterest, Reddit, Threads, Bluesky, Telegram), including automatic publishing via Autopilot that you configure. It can also send newsletters and emails to your own recipient lists. This policy applies to everything created, stored, scheduled, published, or sent from your account.

2. Prohibited Content

You may not use the Service to create, store, schedule, publish, or send:

  • Illegal content: anything that violates US law, your local law, or the law of the destination jurisdiction. Child sexual abuse material is zero tolerance: immediate ban and report to the authorities.
  • IP-infringing content: content that infringes copyrights, trademarks, or other proprietary rights, including uploading brand assets or source material you have no right to use.
  • Deception and impersonation: impersonating real people, brands, or officials in a way intended to mislead; fake endorsements, fabricated testimonials, or fraudulent reviews.
  • Hate and harassment: hate speech, incitement to violence, or harassment of individuals or protected groups.
  • Adult content: pornography or sexually explicit material. Non-consensual intimate imagery is strictly prohibited.
  • Malware and phishing: malware, exploits, phishing pages, scams, or content designed to obtain financial or personal data deceptively.

3. AI-Specific Rules

Because Brainpercent generates content with AI, these rules apply in addition:

  • No disinformation campaigns: no coordinated disinformation, fabricated news, fake political endorsements, or content designed to interfere with elections or suppress voting.
  • No undisclosed deepfakes: no synthetic media depicting real persons without their consent, and no publishing such media without disclosing it as AI-generated where the law requires it.
  • No high-risk uses: the uses listed as prohibited on our AI Transparency page (medical, legal, law enforcement, biometric, and other high-risk decisions) are prohibited here too.
  • Autopilot responsibility: Autopilot can publish without a per-post review. You remain fully responsible for everything published from your account. Review Autopilot output regularly and pause it if the output is not acceptable.
  • No fake reviews: creating fake consumer reviews, testimonials, ratings, or endorsements presented as genuine is prohibited (US FTC Trade Regulation Rule on Consumer Reviews and Testimonials, 16 CFR Part 465).

4. Social Network Rules

When Brainpercent publishes to a connected social account, you are the publisher. You must:

  • Follow each network's terms: comply with the terms of service, community guidelines, and automation policies of every network you connect (Instagram, Facebook, TikTok, LinkedIn, X, YouTube, Pinterest, Reddit, Threads, Bluesky, Telegram).
  • Keep accounts in good standing: if a network flags, removes, or restricts content published through Brainpercent, we may suspend publishing to that network or suspend your account.
  • Connect only authorized accounts: connect only social accounts that you own or are explicitly authorized to manage.

5. Email and Newsletter Rules

If you send newsletters or emails through the Service:

  • Consented recipients only: send only to people who gave you consent to receive your emails.
  • No purchased lists: purchased, rented, scraped, or harvested recipient lists are prohibited.
  • You are the controller: you are the data controller of your recipient lists. Compliance with CAN-SPAM, GDPR, and other marketing laws that apply to your recipients is your responsibility.
  • Mandatory unsubscribe: every email must include a working unsubscribe mechanism, and opt-out requests must be honored promptly.

6. Source Content and Scraping

The Service generates content from URLs and source material you submit:

  • Rights to sources: submit only URLs and content that you own or have the right to use as source material.
  • No circumvention: do not use the Service to scrape sites that prohibit it, bypass paywalls or access controls, or collect personal data without a lawful basis.
  • No abuse of Brainpercent: automated scraping of Brainpercent itself and systematic API abuse outside published rate limits are prohibited (Terms Section 9).

7. Enforcement

We enforce this policy proportionally to the severity of the violation:

  1. Warning: we notify you and require the violating content to be removed or corrected.
  2. Feature suspension: we may suspend specific features (for example Autopilot, publishing to a specific network, or email sending) while the issue is resolved.
  3. Termination: we may suspend or terminate your account under Section 12 of the Terms. Severe violations (for example CSAM, malware, fraud) go straight to termination and may be reported to law enforcement.

No refund is owed for suspensions or terminations caused by violations of this policy.

8. Reporting Abuse

To report abuse, content that violates this policy, or a compromised account, email edward@brainpercent.com with subject "Abuse Report".
